Terms of service
These terms apply to businesses using JobSense. They're written in plain English, but they're a legal agreement, so please read them. If anything's unclear, email hello@axis-it.co.uk.
1. Who we are and what this covers
JobSense is provided by AXIS WORKPLACE TECHNOLOGY LTD, a company registered in England and Wales (company number 16374487), whose registered office is at 450 London Road, Portsmouth, England, PO2 9LD ("we", "us"). These terms are between us and the business that opens a JobSense workspace ("you"). They cover the JobSense software at jobsense.app, its mobile web app, and the pages your customers see (such as reports, quotes, invoices and the customer portal). Our Privacy policy and Data processing terms form part of these terms.
JobSense is for businesses. By signing up you confirm you're acting for a business and have the authority to accept these terms for it. Consumer protection rights that only apply to consumers don't apply to this agreement.
2. Free trial
- A new workspace starts with a 14-day free trial. No card is needed and nothing is charged during the trial.
- To carry on after the trial, choose a plan and add a card. If you don't, the workspace is paused: you and your team can't use it until you choose a plan, although links you've already sent to customers keep working. We keep your data for at least 30 days after the trial ends, and we'll email you before deleting a paused workspace.
3. Plans and how you pay
Each plan (Solo, Team or Business) includes a number of users and an amount of storage, set out on our pricing page and in the app. You can choose to pay in one of three ways:
| Way of paying | How it works |
|---|---|
| 12-month plan, paid monthly | A minimum term of 12 months, billed monthly in advance at the 12-month price. After the first 12 months it continues month to month at the same price until you cancel. |
| 12-month plan, paid yearly | 12 months paid in advance, which costs the same as 11 months on the 12-month plan. It renews for another 12 months unless you cancel before the renewal date. |
| Monthly | No minimum term, billed monthly in advance at the monthly price. Cancel at any time. |
- Prices are shown on our pricing page and in the app. They exclude VAT and other sales taxes, which are added where they apply. If you're a business outside the UK, the reverse charge may apply.
- Bolt-ons (extra users, storage and texts) are billed with your plan, monthly or yearly to match it. One-off text packs are paid when you buy them and are used up that month.
- Changing plan: you can move to a bigger plan, or from monthly to a 12-month or yearly plan, at any time; the difference is charged or credited straight away, pro rata. You can't move from a 12-month plan to monthly until the 12 months are up, or from a yearly plan to a monthly one until the year ends.
- Payment is taken by our payment provider, Stripe, from the card you add. We never see your full card details. If a payment fails, Stripe will try again over a few days and we'll let you know. If payment still isn't made, we may restrict the workspace until it is.
- Price changes: we may change our prices, but we'll give you at least 30 days' notice by email. A price change won't affect a 12-month or yearly plan until its current 12 months end.
4. Cancelling
- Cancel from Business settings › Plan & billing, or by emailing hello@axis-it.co.uk.
- Monthly: the plan ends at the end of the month you've paid for.
- 12-month plan, paid monthly: during the first 12 months, cancelling ends the plan when the 12 months are up, and the monthly payments continue until then. After that, it ends at the end of the month you've paid for.
- Yearly: the plan ends at the end of the year you've paid for and doesn't renew.
- Payments already made aren't refunded, except where the law requires it or we've agreed otherwise in writing. You keep full use of JobSense until your plan ends.
5. Card payments from your customers
If you connect a Stripe account, your customers can pay deposits and invoices by card. Those payments go to your own Stripe account, under Stripe's terms between you and Stripe. You're responsible for your Stripe account, refunds, disputes and chargebacks. Stripe's own fees apply, and we charge a platform fee of 1% of each card payment, up to a maximum of £10 (or €10 or $10) per payment, which Stripe collects for us when the payment is made. We don't hold your customers' money. If you give a customer a full refund, email us and we'll refund our fee on that payment.
6. Your account and your team
- You're responsible for the people you add to your workspace and what they do in it, and for keeping sign-in details secure.
- Tell us straight away at hello@axis-it.co.uk if you think someone has got into your workspace without permission.
7. Your data
- It's yours. You own the jobs, customers, photos, videos, documents and other content you put into JobSense.
- You give us permission to store and process it only so we can provide JobSense to you, as set out in our Data processing terms.
- You're responsible for having the right to put your customers' data into JobSense and to contact them, including getting any consent needed before sending them texts or emails.
- You can export your data, and ask us to delete your workspace, at any time. When your workspace is closed we delete its data within 30 days, and backups roll off within a further 35 days.
8. Acceptable use
Don't use JobSense to break the law; send messages people haven't agreed to receive; upload anything you don't have the right to, or anything harmful, misleading or illegal; try to get into other businesses' data; overload, probe or get around the security or limits of the service; or resell it without our agreement. We may suspend a workspace that breaks these rules. Unless it's urgent, we'll tell you first and give you a chance to put it right.
9. The service
- We'll provide JobSense with reasonable skill and care and aim to keep it available at all times, apart from planned maintenance and events outside our control.
- We keep improving JobSense, so features may change. We won't remove a core feature you're paying for during a 12-month or yearly term without telling you and offering a fair solution.
- Documents JobSense helps you produce, such as certificates, RAMS, quotes and invoices, are yours. You're responsible for checking they're correct and meet the rules that apply to you (for example your trade scheme, HMRC or the regulations in your country).
10. Liability
- Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud.
- We aren't liable for indirect or consequential losses, or for loss of profit, revenue, business or goodwill.
- Otherwise, our total liability to you in any 12 months is limited to the fees you paid us in those 12 months, or £100 if that's more.
11. Ending this agreement
You can stop using JobSense as described in section 4. We can end this agreement with 30 days' notice, or straight away if you seriously or repeatedly break these terms, or don't pay after we've asked you to. If we end it without you having done anything wrong, we'll refund any fees paid for the period after it ends.
12. Changes to these terms
We may update these terms. If a change matters, we'll email workspace owners at least 30 days before it takes effect. If you don't agree with it, you can cancel before it takes effect without the 12-month minimum applying.
13. General
These terms are the whole agreement between us about JobSense. If any part can't be enforced, the rest still applies. You can't transfer this agreement without our agreement; we may transfer it to a business that takes over JobSense, and we'll tell you if we do. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
